Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Withdrawal period: The time frame during which the consumer may exercise the right of withdrawal.

  • Consumer: The natural person who is not acting within the scope of a commercial, business, or professional activity and who enters into a distance contract with the company.

  • Day: A calendar day.

  • Long-term agreement: A distance contract relating to a series of products and/or services whose supply or delivery obligation is spread over time.

  • Durable medium: Any means that enables the consumer or the company to store information addressed personally to them in a way that allows future access and unchanged reproduction.

  • Right of withdrawal: The consumer’s right to withdraw from a distance contract within the withdrawal period.

  • Company: The natural or legal person who, through Lynelle, offers products and/or services remotely to consumers.

  • Distance contract: An agreement concluded within the framework of an organized system for distance selling, using one or more means of remote communication.

  • Means of distance communication: Any method that can be used to conclude a contract without the consumer and the company being physically present together.

  • Terms & Conditions: The present general terms and conditions of Lynelle.


Article 2 – Right of Withdrawal

The consumer has the right to withdraw from the agreement within 30 days, without giving any reason.
During this period, the consumer must handle the product and its packaging with care.

If the consumer exercises the right of withdrawal, the product must be returned with all accessories and, as far as possible, in its original condition and packaging, following reasonable instructions provided by the company.


Article 3 – Scope

These Terms & Conditions apply to all offers made by Lynelle, as well as all distance contracts and orders between the company and the consumer.

Before an agreement is concluded, the consumer shall have access to the text of these terms.
If this is not reasonably possible, the consumer will be informed where these terms can be reviewed and that a free copy can be sent upon request.

If the agreement is concluded electronically, the terms will be made available in a manner that allows the consumer to easily save them on a durable medium.

If special product or service terms also apply, these will prevail only where they are more favorable to the consumer.

If any provision of these terms is invalid, the remaining provisions will remain in effect.
Any ambiguities shall be interpreted in the spirit of these terms.


Article 4 – The Offer

If an offer is subject to a limited validity period or specific conditions, this will be clearly stated.
Offers are non-binding and may be modified by Lynelle.

The offer includes a clear and accurate description of the products and/or services so that the consumer can assess them properly.
Images used by Lynelle are realistic representations, but color variations may occur due to screen settings.

Each offer shall clearly state:

  • Any applicable shipping costs,

  • How the agreement is concluded,

  • Whether the right of withdrawal applies,

  • Payment, delivery, and performance terms,

  • The validity of the offer and prices,

  • How the consumer can verify and correct input errors before confirming the order.


Article 5 – The Agreement

The agreement is concluded once the consumer accepts the offer and meets the applicable conditions.

If the offer is accepted electronically, Lynelle will confirm receipt electronically.
The agreement becomes binding only when the consumer receives this confirmation.

Lynelle takes appropriate technical and organizational measures to ensure secure data transmission and electronic payments.

Before accepting an agreement, Lynelle reserves the right to obtain information on the consumer’s creditworthiness.
If there are reasonable grounds to refuse, Lynelle may decline or make acceptance subject to additional conditions.

Upon delivery, the consumer receives in writing or electronically:

  • Lynelle’s customer service contact details,

  • Instructions on exercising the right of withdrawal,

  • Warranty and after-sales information,

  • The main contractual terms.

All agreements are subject to product availability.


Article 6 – Withdrawal for Goods

Consumers may withdraw within 30 days after receiving the product.
During this time, the consumer must handle the product and packaging with care.

Withdrawal must be notified to Lynelle in writing or by email within 30 days of receipt.
The product must then be returned within 30 days after the notification.
Proof of return must be retained.

If the consumer fails to notify or return the product within these periods, the purchase is considered final.


Article 7 – Costs of Withdrawal

If the consumer exercises the right of withdrawal, they shall bear the cost of return shipping.

If payment has already been made, Lynelle will refund the amount as soon as possible and no later than 30 days after receiving the returned goods or proof of return.


Article 8 – Exceptions to the Right of Withdrawal

Lynelle may exclude the right of withdrawal for certain products if clearly stated before the contract is concluded.

Withdrawal is not possible for goods that:

  • Are made to the consumer’s specifications,

  • Are of a personal nature,

  • Cannot be returned due to their nature,

  • Are perishable or may expire quickly,

  • Are subject to price fluctuations on financial markets beyond Lynelle’s control,

  • Are newspapers, magazines, or similar periodicals,

  • Contain sealed audio/video software where the seal is broken,

  • Are hygiene products where the seal has been broken.


Article 9 – Price

Prices remain unchanged during the stated validity period unless affected by changes in VAT or other taxes.

Lynelle may offer products whose prices depend on financial market fluctuations beyond its control — this will be stated in the offer.

Price increases within three months of contract conclusion are only allowed if required by law.
After three months, changes may occur only if agreed and:

  • Required by law, or

  • The consumer has the right to cancel from the date the new price takes effect.

All prices are subject to typographical errors.
Lynelle is not obliged to honor clearly incorrect prices.


Article 10 – Conformity and Warranty

Lynelle guarantees that the delivered products and/or services comply with the agreement, product descriptions, and legal standards of usability, reliability, and safety.

Manufacturer or importer warranties do not affect the consumer’s legal rights.

Defective goods must be reported to Lynelle within 30 days of receipt.
Returned goods must be in original packaging and condition.

The warranty period follows the manufacturer’s warranty.
Warranty does not apply if:

  • The consumer has repaired or altered the product,

  • The product was misused or exposed to abnormal conditions,

  • The defect resulted from regulatory requirements regarding materials or manufacturing.


Article 11 – Delivery and Execution

Lynelle exercises the utmost care in processing and delivering orders.

Unless otherwise agreed, delivery will take place as soon as possible and no later than 30 days after ordering.
If delivery is delayed or partially fulfilled, Lynelle will notify the consumer within 30 days.
In that case, the consumer may cancel the order and receive a full refund.

If a product cannot be delivered, Lynelle may offer an alternative.
The right of withdrawal applies to substitute goods, and Lynelle bears the return shipping cost.

The risk of damage or loss passes to the consumer once the product is delivered to them or a designated recipient.


Article 12 – Long-Term Agreements: Duration, Termination, and Renewal

Termination:
Consumers may terminate an indefinite agreement for ongoing deliveries with at least one month’s notice.
For fixed-term contracts, termination may occur at the end of the term with the same notice period.

Termination can be made using the same method as the agreement was entered into.

Renewal:
Fixed-term agreements cannot be automatically renewed for a fixed duration, except for subscriptions (e.g., magazines) renewed for up to three months, provided the consumer may cancel at any time with one month’s notice.

Contracts renewed indefinitely may be terminated by the consumer with one month’s notice (or three months if deliveries occur less frequently than once per month).

Trial or introductory subscriptions end automatically and are not renewed.

Duration:
For agreements lasting more than one year, the consumer may cancel after one year with one month’s notice, unless otherwise required by fairness or law.


Article 13 – Payment

Unless otherwise agreed, payment must be made within 7 business days of the start of the withdrawal period.

For services, the payment term begins on the date the consumer receives confirmation of the agreement.

Consumers must promptly inform Lynelle of any inaccuracies in payment details.
In case of non-payment, Lynelle may charge reasonable reminder and collection costs within legal limits.


Article 14 – Complaints Procedure

Complaints must be submitted to Lynelle within 7 days after the defect has been discovered and must include a clear description.

Lynelle will respond within 14 days of receiving the complaint.
If more time is needed, the consumer will be informed of the expected response time.

If a complaint cannot be resolved amicably, it may be submitted to an appropriate consumer dispute body.

Submitting a complaint does not exempt the consumer from payment obligations unless confirmed in writing by Lynelle.
If Lynelle deems a complaint justified, the company will repair, replace, or refund the product.


Article 15 – Disputes

All agreements between Lynelle and the consumer are governed by law, even if the consumer resides abroad.
